Terms & Conditions

Please read these terms and conditions carefully as it governs the relationship between us and you and limits our liability to you when you purchase products from us. By accepting these terms and conditions you are forming a contract with us and agreeing to the terms and conditions that appear below. References to “you” and “your” are to you as an individual. References to “us”, “our” and “we” are to Theo & Tilly.

All prices on the website are in GBP (£) and include VAT at the current rate, except items for sale that are zero rated, such as books and children's clothing.

SALE OF PRODUCTS

Upon placing your order, you will receive an order confirmation by email. This confirmation is not an acceptance of the order nor is it a confirmation of our offer to sell. An order is deemed to be an offer by the customer to purchase items on our website and  and is subject to acceptance by us. We may choose not to accept an order for any reason. Payment of any order is required before it is despatched. Once an order has been accepted by us, paid for by you and despatched the contract between us is deemed to be concluded.

Payment can be made by PayPal via their secure servers, or by card payment over the phone.

You must ensure that your personal details, including the address for delivery, are complete and accurate.

We reserve the right to alter or withdraw products given on this website at any time. We shall endeavour that all orders are met. We do not, however, guarantee the availability of any product at any time. You acknowledge that sometimes products may be withdrawn or discontinued. We shall make every effort to update the website at all times. 

All prices include VAT at 17.5%, books and magazines are zero rated. VAT is deducted for customers of Channel Islands and outside the EU. The delivery address must be in these countries otherwise the VAT will be added. 

DELIVERY

Delivery costs are clearly displayed before finalising your order. Delivery of the products shall take place at the delivery address entered on your order. On UK orders we send all items by Royal Mail Recorded Delivery. Postage costs £4.95 on orders up to £100 and are sent free of charge over £100. 

Postage for items to be sent outside of the UK are charged at actual cost. Once you order has been placed we will contact you to discuss shipping charges. You may cancel your order at any time after placing the order if the shipping charges do not meet with your approval.

We aim to ship within 48 hours of receipt of your order. If an item is out of stock and likely to delay shipment of your order we will contact you immediately for your further instructions.

PRICE AND PAYMENT

Unless otherwise agreed between you and us, the price for the products shall be the price advertised upon your login on the website as published on the date of the order. All prices include VAT at 17.5%, books and magazines are zero rated. VAT is deducted for customers of Channel Islands and outside the EU. The delivery address must be in these countries otherwise the VAT will be included (VAT no. 935031546). Postage and packaging is added to your order at checkout. We reserve the right to change prices without notice.

CANCELLATION AND RETURNS POLICY


In the event that any order is incorrect, the customer must notify us within 7 (seven) days after delivery. We abide by the Distance Selling Regulations (DSR). If we made a mistake or if the product is faulty or damaged, the product shall be returned to us at our cost (first class or first class recorded). Please obtain a free proof of posting from the Post Office and please ensure that the good are packaged adequately to protect against damage. We will send a replacement at our own cost.

If you wish to return an item for any other reason (unwanted, not as you thought, changed your mind), please put this in writing to us indicating, if possible, the invoice number. In this circumstance, the customer agrees to pay for the postage to return the goods to us as per the DSR. This cost shall not be refunded. When returning the items, please obtain a free proof of posting from the Post Office and please ensure that the good are packaged adequately to protect against damage.  If a refund is due, the refund or a credit note (coupon code redeemable on our website or in shop, only if the customer prefers this option) will be processed within 30 days to the cost of the goods being returned. 

If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

This policy does not affect your legal rights, for example, if goods are faulty or misdescribed.

If there is a problem with the goods, please contact us. We will deal with the matter in accordance with your legal rights.

These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.

IMPORT TAXES AND DUTY

The buyer is liable for all duty, tax and other import charges as may arise on international purchases.

GOVERNING LAW AND JURISDICTION
The agreement between you and us shall be governed by the law of Scotland and you and we shall both submit to the jurisdiction of the Scottish Courts.
